Duration The training credits purchased will be valid for twelve months from the purchase date and can be used to book face-to-face or e-learning training courses. At the expiration of the twelve months, Nirmatra Training Solutions will neither refund any fees nor reimburse any other costs if the credits have not been used. User agrees that neither Company nor its group companies, directors, officers or employee shall be liable for any direct or/and indirect or/and incidental or/and special or/and consequential or/and exemplary damages, resulting from the use or/and the inability to use the service or/and data or/and information or/and services purchased or/and obtained or/and messages received or/and transactions entered into through or/and from the service or/and resulting from unauthorized access to or/and alteration of user’s transmissions or/and data or/and arising from any other matter relating to the service, including but not limited to, damages for loss of profits or/and use or/and data or other intangible, even if Company has been advised of the possibility of such damages.

User further agrees that Company shall not be liable for any damages arising from interruption, suspension or termination of service, including but not limited to direct or/and indirect or/and incidental or/and special consequential or/and exemplary damages, whether such interruption or/and suspension or/and termination was justified or not, negligent or intentional, inadvertent or advertent.

User agrees that Company shall not be responsible or liable to user, or anyone, for the statements or conduct of any third party of the service. In sum, in no event shall the Company’s total liability to the User for all damages or/and losses or/and causes of action exceed the amount paid by the User to the Company, if any, that is related to the cause of action.

All intellectual property rights in all Training Materials available, including the design, graphics and text of all printed materials and the audio of all webinars and podcasts, are owned by Nirmatra Training Solutions. When you are given access to the Training Material, you are granted a non-exclusive, non-transferable, revocable licence to use the Training Material. No Training Material may be copied, reproduced, uploaded, posted, displayed or linked to in any way, in whole or in part, without Nirmatra Training Solutions’ prior permission. Any such use is strictly prohibited and will constitute an infringement of Nirmatra Training Solutions’ intellectual property rights.

Bookings Standard training. Standard Face-to-face training and e-learning courses can be booked via the booking forms available on Nirmatra Training Solutions website. When you submit a booking for an online course, your submission represents an offer to Nirmatra Training Solutions, to book you onto the course you selected. On submission of the face-to-face training course or e-learning course form, you will receive an automated summary email of your selection. Nirmatra Training Solutions will accept your offer by entering your booking into Nirmatra Training Solution system and sending you an email confirming that you have been booked together with information on starting your learning.

YOUR OBLIGATIONS You may not allow anyone else to access the e-training courses via your log-in details. You must comply with all health and safety rules and regulations and any other reasonable security requirements that apply at the premises at which the training courses are provided. Nirmatra Training Solutions reserves the right to remove any delegate from a training course whose behaviour is deemed inappropriate by Nirmatra Training Solutions or its trainers. In these circumstances, Nirmatra Training Solutions will neither refund any fees nor reimburse any other costs.

WARRANTY AND DISCLAIMER Nirmatra. ensures that all our training services are delivered diligently and in a good, timely and professional manner consistent with industry standards. The training services will be performed as described in the individual class agendas. Nirmatra Training solutions. shall provide such trainers to present the training course as it, in its sole discretion, deems fit and Nirmatra Training solutions. shall be entitled at any time to substitute any trainer with any other person who, in Nirmatra Training Solutions. sole discretion, it deems suitably qualified to present the relevant course. Nirmatra Training solutions. does not warrant that the provision of any content online will always be available or be uninterrupted, timely or error-free, that defects will be corrected or that such content is secure or free from bugs, viruses, errors and omissions.
